As you browse our site and dream of how you may enjoy your backyard, patio, or deck on your Yardbird furniture, have confidence that we take our responsibility to you seriously.

This Privacy Policy describes important legal rights regarding your information and you should read it carefully. If you are a resident of California, Colorado, Connecticut, Oregon, Texas, Utah or Virginia, you may have additional rights, which are described in our State Privacy Rights page. Summary of Privacy Practices

Collection

We may collect information relevant to you in three ways:

• Directly from you, such as in-person interactions at our retail stores, during in-home visits, or over the phone, or when you provide information via our digital properties such as our website.

• By observing behavior — either in the “real world” or through our digital properties like websites and mobile apps. Examples include security cameras at a retail store, our websites tracking visitor activities on our sites, or our digital properties collecting the characteristics of the devices that visit.

• From independent third parties, independent of you.

Use

We will use your information to meet your expectations and give you a great experience with Yardbird. For example, we may use your information to: 

• Fulfill a purchase 

• Provide a service 

• Make our digital properties run better 

• Inform you about products and services that we think you’ll find useful 

You’ve probably seen in the news that the world (especially the internet) has too many fraudsters, hackers, and criminals. We use the information we collect to protect our customers, Yardbird, and others from such bad actors.

Sharing 

If you post something on a public forum on one of our digital properties, it should come as no surprise to you that it may be viewed by the general public.  

We may share your personally identifiable information with suppliers or businesses to help us: 

• fulfill your requests or perform a contract that we have with you 

• carry out internal processes to run our business using information technology providers under contract to us  

• enforce our legal rights, respond to a request from law-enforcement authorities, or when we are required by applicable law.  

Finally, Yardbird is a part of the Best Buy family of companies. These companies may share personally identifiable information with each other. If one of these family members later goes off on their own, either after being acquired by a third party or merging with a third party, they will share personally identifiable information with that third party subject to the applicable privacy policy. 


Yardbird Privacy Policy

This Privacy Policy applies to Yardbird retail showrooms, other locations and events conducted or presented under the Yardbird name, and digital properties owned or operated by or for Yardbird. Other retail operations or digital properties operated by our parent Best Buy Co., Inc. are governed by the privacy policy posted for those brands or entities.  

Our State Privacy Rights page includes definitions and content designed to meet the requirements of state law. 

Information we collect 

We may collect the following categories of information in our interactions with you. Where this information identifies you directly or can be associated with your identity, we will consider it personal information. Information that we cannot reasonably associate with your identity is not considered personal information. 

Information you give us

• Payment card number or other payment information 
• Driver’s license number (for example, on a credit application) 
• Social Security number (for example, on a credit application) 
• Location Information (for example, to help you find a nearby showroom) 
• Demographic and lifestyle information (for example, to help you evaluate which products fit your needs)

Information from other sources 

We may receive information about you from other sources, including third parties that help us update, expand, and analyze our records, or to help us identify new customers and offer products and services that may be of interest to you. 

Information collected automatically online 

When you interact with our digital properties, we may collect: 

• The type of device or browser you are using 
• Your IP address 
• Your browsing behavior on our website 
• The URL of the website you visited before you visit our website (also known as a “referring URL”) 
• IMEI/UDID (a numeric identifier for mobile devices) 
• MAC address (another type of identifier for a mobile device) 
• IDFA (Apple’s ID for Advertising, a randomly generated number on Apple devices) 

We use cookies and other similar technologies to analyze trends and traffic on our website, administer and maintain the website, and gather user information about visitors to our website. You can control the use of cookies and similar technologies within your browser, however disabling all cookies may impair or disable certain features of the website.  

We may permit third party service providers to collect and process some information from our digital properties. We may share personal information with those providers and may have similar arrangements with
interest-based advertisers. Because of a lack of standardization, our website is not designed to respond to “do not track” requests from browsers. 

Location information 

Our website may collect location information from your device. We may use this information to, for example, display nearby showroom locations. You may control or disable access to device location information
within the settings of your mobile device. While doing so may limit our ability to know your location information, it does not completely eliminate the ability of other others to develop location information associated with your device. 

Information you give us about others 

You may provide us with information about other people from time to time, such as a person authorized to receive shipment of your purchase. You represent, and we will rely on, your authority to provide that person’s information to us. We will use their information consistent with this Privacy Policy, subject to any limitations related to the specific purpose for which it was provided. 

Showroom cameras 

We may use cameras within our showrooms to monitor our business operations and help ensure safety and security. 

Reviews and other content you provide 

Our website offers publicly available comment forums. Be aware that anyone who access these forums may read, collect, and use information you provide. 

How we use your information 

We use the information we collect about you in several ways. These uses allow us to fulfill your orders and provide the service you expect from us, but also allow us to continually improve our products and our business. We may use your information in any of the following ways:

Interest based advertising

This may include interest-based advertisements on our website and on other third-party websites. The browsing history we use is collected by us and by third parties on our website and on other sites. You can opt out of interest-based advertising from third party providers who follow the Digital Advertising Alliance’s Self Regulatory Principles for Online Behavioral Advertising at www.aboutads.info/choices.  

How we share your information 

Yardbird does not exchange your information for monetary consideration—what is commonly understood as “selling data.” We may share your information as described below, including for targeted advertising purposes. We may also combine or aggregate your information with information about other people, and that information may be shared within our corporate family of affiliated companies. 

We may share your information with third parties to perform services on our behalf: 

• Fulfilling orders and delivering products 
• Scheduling and performing installations or set up 
• Providing customer care and support 
• Sending our marketing communications 
• Personalizing the customer experience on our digital properties 
• Maintaining your account
as part of our professional trade program
• Fulfilling subscriptions or warranty obligations 
• Conducting research and analysis 
• Processing payments 
• Detecting fraud or other illegal activity 

We may also share your information in connection with co-branded products or services, including sharing with a business partner to
validate offers or eligibility. Where we offer financing for purchases, we will
share information with third party companies that help you finance your purchase. 

We may share information for legal reasons, such as where required by law or regulation, to respond to a court order, subpoena, or other legal process. We reserve the right to share your information when we
believe it is necessary to comply with a law or regulation, respond to a
government request, or when we believe sharing is necessary or appropriate to protect us, our affiliated companies, customers, or others. 

In the event of a corporate sale, merger, acquisition, joint venture, reorganization, divestiture, dissolution, liquidation, or
similar event, we may share personal information.

Online chat feature

Yardbird offers an online chat feature to help enable customer service and support, as well as sales and purchasing activities. We have engaged a third party service provider to facilitate this communication, which may enable this service provider to view your chats as a part of providing service and support to us.

How we protect your information 

We use a risk-based approach designed to ensure appropriate protection for your personal information. We employ administrative, physical, and technical controls designed to safeguard the confidentiality of
your information. However, no set of controls can be perfect and we do not guarantee the security of information transmitted to us. 

If you create a user account on our site, use a strong password. This password should be unique to our site and you should not reuse
your Yardbird password on other sites. Do not share your password with anyone, especially someone who calls you claiming to work for us. We will never ask you for your password. 

Your choices 

You may contact us any time to exercise these choices: 

• Stop receiving marketing or promotional communications such as email, direct mail, phone, or mobile (e.g. SMS or “text”) marketing 

• Update or correct your information 

• Deactivate your account 

• Request removal of information you have posted on our online forums. We may not be able to remove all content, and if we are unable
to fulfill your request, we will tell you and provide the reason why we
cannot. 

You can exercise these choices by following the opt out link in any marketing email or following the directions in other communications
from us. You may also contact us using the methods identified below. 

We may fulfill your to request deactivate or remove your information by removing identifiers, making the information anonymous information. Doing so may not completely remove your personal information from the internet. 

 Children’s privacy 

We do not knowingly collect or solicit personal information from children under the age of 16 without parental consent. If we learn that we have collected information from a child under the age of 16 without parental consent, we will promptly delete that information. If you believe a child under the age of 16 may have provided us with personal information without parental consent, please contact us using one of the methods below. 

Links to other websites 

Our websites contain links to other websites. When you follow one of these links, please be aware that the other website may have its own privacy policy and terms of use, which you should review. 

Social media 

Our website includes ways to interact and share using social media, through features such as a “thumbs up” button, “share this” button, or interactive mini-programs that run on our website (“widgets”). These features may collect information such as your IP address or the page you are visiting on our website and may set cookies to enable the feature to function properly. Social media features can be hosted by a third party or hosted directly on our website. Your interactions with these features are governed by the privacy policy of the social media company providing the feature. 

Updates to this policy 

We may update this policy as our business grows, customer expectations evolve, and as laws and regulations change. Changes and clarifications will be effective immediately upon posting to our website unless a different date is specified. If we make material changes to this policy, we will notify you that it has been updated with a conspicuous notice on our website and, if we have an email address on file as part of an online account, we will email you about the changes.  .
